Terms

Terms of Service

These terms govern use of the Almonry website and application, operated by MADE180 Digital Solutions (“MADE180,” “we,” “us”). By creating an account, signing in, or using Almonry on behalf of an organization, you agree to them. If you are agreeing on behalf of an organization, you confirm you have the authority to do so, and “you” includes that organization.

1. The service

Almonry provides donor management, online giving, fundraising pages, receipting, reporting, and donor outreach tools for nonprofit organizations (“Customers”). We may add, change, or retire features over time. Some features are provisioned per organization and may not be available to every Customer.

2. Accounts

Each staff user needs their own sign-in. You are responsible for keeping your credentials confidential and for everything done under your account. Tell us promptly if you believe an account has been compromised. An organization’s administrators control who may access its data and may remove access at any time.

3. Your data

You own the donor records, gift history, content, and other data you put into Almonry (“Customer Data”). You grant us the limited rights needed to host, process, back up, and display it in order to provide the service. We will not sell Customer Data or use it for advertising. Our Privacy Policy describes how we handle it.

You are responsible for the accuracy and lawfulness of Customer Data, for having the right to store and use it, and for honoring the consent and privacy choices of the people in it. You can export your data at any time.

4. Payments and giving

Online gifts are processed by Stripe under a connected account that belongs to the Customer. Funds are paid out by Stripe directly to the Customer’s bank account; Almonry does not hold donor funds. Stripe’s processing fees apply to each transaction and are set out in your Stripe agreement. You are responsible for completing Stripe’s onboarding, for the accuracy of your tax-exempt status and EIN, and for the content of the receipts and statements issued in your name.

Almonry generates tax receipts and year-end statements from the information you provide. We do not give tax or legal advice. Review the receipt language with your own advisors to confirm it meets the requirements that apply to your organization.

5. Fees

Pricing for the Almonry service is set out in your order or agreement with MADE180. Fees are billed as stated there. Taxes are your responsibility unless you provide a valid exemption. We may change pricing with at least 30 days’ notice before the next billing period.

6. Acceptable use

You agree not to:

  • send email or text messages to people who have not consented, or ignore unsubscribe and STOP requests;
  • use Almonry for anything unlawful, deceptive, or harmful, including fraudulent solicitation;
  • attempt to access another organization’s data, probe or disrupt the service, or circumvent its security;
  • upload malicious code or content that infringes someone else’s rights;
  • resell or sublicense the service without our written agreement.

Almonry enforces consent rules when audiences are built, but you remain responsible for complying with CAN-SPAM, the TCPA, and any other laws that apply to your outreach.

7. Third-party services

Almonry works with services provided by others, including Stripe for payments, Resend for email, Twilio for text messages, Anthropic for the Dori assistant, and Canva for optional design features. Your use of those services is also subject to their terms. Connecting your Canva account is optional and can be undone at any time. We are not responsible for third-party services, and their availability may change.

8. The Dori assistant

Dori drafts messages and answers questions from your data. Its output may be incomplete or wrong. You are responsible for reviewing anything Dori produces before relying on it or sending it to anyone.

9. Our intellectual property

Almonry, its software, design, and documentation belong to MADE180 and its licensors. These terms do not give you any rights in them beyond the right to use the service. Your organization’s name, logo, and content remain yours.

10. Availability and support

We work to keep Almonry available and will give notice of planned maintenance where we can. We do not guarantee uninterrupted service. Support is provided by email during normal business hours in the Eastern time zone.

11. Suspension and termination

You may stop using Almonry at any time. We may suspend or end access if you breach these terms, if required by law, or if continued service would create a security or legal risk, and we will tell you why where we reasonably can. On termination you may export your Customer Data for 30 days, after which we delete it as described in the Privacy Policy.

12. Disclaimer

Almonry is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will meet every requirement or be error-free.

13. Limitation of liability

To the fullest extent permitted by law, MADE180 will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost revenue, donations, or data, arising from use of the service. Our total liability for any claim relating to Almonry is limited to the fees you paid us in the twelve months before the claim arose.

14. Indemnity

You will defend and indemnify MADE180 against claims arising from your Customer Data, your outreach, or your breach of these terms.

15. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Jefferson County, Kentucky, and you consent to their jurisdiction.

16. Changes

We may update these terms. We will post the new version here, update the effective date, and notify Customers by email of material changes at least 30 days before they take effect. Continued use after that date means you accept the new terms.
